Where the Actos Lawsuits Stand

Actos is a prescription drug manufactured by Takeda, a Japanese pharmaceutical corporation, over thirteen years ago and is used in the treatment of Type 2 diabetes. While there were many adverse health issues reported among users of Actos, the drug remains on the market even though France and Germany have withdrawn it from their markets. Actos has been definitively linked to a much higher rate of bladder cancer among users and can also increase the risk of adverse cardiovascular events, liver problems and macular edema. For patients who have taken the drug for periods longer than a year or in especially high dosages, there may be as much as a forty percent increase in the incidence of bladder cancer. Although bladder cancer is treatable, it has an extremely high rate of recurrence therefore Actos users may find their lives forever changed from a drug they believed to be safe.

The FDA issued a warning to Actos users in 2010 regarding its potential cancer risks, however were slow to take any further action until June of 2011 when they ordered Takeda to add new warnings to the labeling of Actos.  The first Actos lawsuit was filed in July of 2011, with numerous more that followed. Bloomberg reported in March of 2012 that Takeda could easily face as many as 10,000 claims related to Actos bladder cancer.  The majority of the lawsuits are expected to allege that the Takeda and Eli Lilly were aware of the increased risk of bladder cancer among Actos users but failed to adequately warn patients.

On June 12, 2012, a New York woman filed a $10 million dollar lawsuit against Takeda, alleging she developed bladder cancer as a direct result of taking Actos for five years. In September of 2012, the Canadian Medical Association Journal stated that those taking the drug Actos for the treatment of Type 2 diabetes were at a significantly increased risk of developing bladder cancer. Despite the controversy surrounding the drug, the FDA approved the first generic version of Actos on August 17, 2012—albeit with a warning label which notes the increased risk of bladder cancer among those taking the drug for longer than a year.

According to the most recent court documents, a lawsuit was filed in the Superior Court of Los Angeles by an Actos user who is alleging bladder cancer as the result of taking the drug. This lawsuit is set for trial on February 19th, 2013.  This is expected to be a very important case for the future of those injured by Actos and is just one of many Actos bladder cancer lawsuits pending in a consolidated proceeding underway in Los Angeles Superior Court. Aside from the California proceedings there are hundreds of Actos lawsuits pending in an MDL in the Western District of Louisiana, with the first trial set for November of 2014, and the second in July, 2015.

Actos users who developed bladder cancer after taking the drug could be entitled to compensation for the medical expenses they have been subject to, lost wages and pain and suffering.
