Have You Suffered Stryker Rejuvenate/ABGII Metallosis or Metal Poisoning?

Following the Stryker Rejuvenate/ABGII hip recalls, many of those with a Stryker hip implant found themselves wondering about their own injuries and unsure of what to do next. Stryker noted a tendency of the implants to cause Stryker Rejuvenate/ABGII hip fretting and corrosion, leading to Stryker Rejuvenate/ABGII hip metallosis and metal toxicity. When the recipient of a Stryker hip implant engages in activity, the metal parts of the hip device rub against one another, causing tiny metal ions to shear away, traveling to hip tissues or to the bloodstream. After the Stryker Rejuvenate/ABGII hip recalls, it was found that the Stryker Rejuvenate/ABGII hip trunnions located on either end of the neck component could trap body fluids, leading to even more corrosion. Stryker Rejuvenate/ABGII hip cross ionization was also found to be a problem as Stryker paired a titanium stem with a cobalt and chromium neck.

Metallosis symptoms include deterioration of bone and tissue, chronic pain and inflammation, total Stryker Rejuvenate/ABGII hip implant failure and the necessity for Stryker revision surgery. Each person will have different tolerance levels to the build-up of heavy metals in the body; while relatively low levels of cobalt and chromium can cause some people serious, adverse health symptoms, other patients with very high levels of heavy metals may not yet have experienced adverse effects. If you have experienced any symptoms of metallosis or Stryker Rejuvenate/aBGII hip chromium & cobalt blood poisoning, it is important to speak to a New Hampshire Stryker Rejuvenate/ABGII hip lawyer as soon as possible.

Why You Must Be Aware of the New Hampshire Stryker Rejuvenate/ABGII Hip Statute of Limitations

Plaintiffs in each state must bring action within a certain period of time as prescribed in the state’s statute of limitations. In most states the time period begins when the plaintiff discovered—or should have discovered—the injury, although some states begin this time period when the injury actually occurs. Other states have enacted statutes of repose, barring actions which are not brought within a specific period of time after an event has taken place. This “event” could be something like the initial sale of a Stryker Rejuvenate/ABGII hip implant, or could be the date the device was implanted. Most states operate under a two-year statute of limitations, however New Hampshire allows three years from the date the injury occurs—except where a legal duty has been imposed by the government, in which case the action must be brought within six years. New Hampshire also has a twelve-year statute of repose which begins when the defective product is manufactured and first sold. The New Hampshire Stryker Rejuvenate/ABGII hip statute of limitations can be much more complicated than it appears, therefore you should speak to a knowledgeable New Hampshire Stryker Rejuvenate/ABGII hip lawyer to determine when your statutes will run.

The Current Status of Stryker Rejuvenate/ABGII Hip Lawsuits

Although more than 20,000 Stryker Rejuvenate/ABGII hip implants were sold, so far, only 2,300 lawsuits have been filed against Stryker. The majority of these cases have been consolidated under Stryker Rejuvenate/ABGII hip multidistrict litigation in New Jersey and Minnesota, with approximately sixty Stryker Rejuvenate/ABGII hip MDL consolidation suits in Florida. Seventeen Stryker hip lawsuits have been settled through mediation, and others are currently being chosen as bellwether cases to represent larger groups of Stryker cases. Bellwether cases are meant to give all those involved an idea of how judges and juries will react to the information and evidence provided in the cases.
