It is estimated that over 20,000 people were implanted with a Stryker Rejuvenate or ABGII hip implant between the release of the two devices in 2010, and the recall in July, 2012. Soon after implantation, many recipients of one of these devices began showing symptoms of metallosis and metal toxicity. The Stryker Rejuvenate/ABGII fretting and corrosion led to Stryker Rejuvenate/ABGII hip necrosis and the necessity of Stryker hip revision surgery.
Current Status of Stryker Rejuvenate/ABGII Hip Lawsuits
There are currently more than 2,300 lawsuits filed against Stryker, and as the statute of limitations grows to a close for some patients, that number is expected to rise. Since mediation efforts have been started, eighteen cases to date have gone through the process, with at least seventeen of those achieving settlement agreements. An additional three lawsuits are scheduled for mediation by the end of July, 2014, and another ten are expected to be assigned for mediation in August.
The terms of the settlements has been deemed confidential, however it is believed the plaintiffs received at a minimum, compensation for their past and future medical bills related to the Stryker Rejuvenate or ABGII. Additionally, plaintiffs may have received compensation for pain and suffering, diminished quality of life, loss of consortium and lost wages, both past and future. A group of Stryker trial cases are being prepared; these cases are known as bellwether trials and are chosen as representative of the common claims made against Stryker. While the outcomes of the bellwether trials are not binding to other plaintiffs, they do provide both sides the opportunity to gauge judge and jury reactions to presented evidence.
When Stryker Rejuvenate/ABGII Hip Revision Surgery Becomes Necessary
Patients who have experienced advanced levels of metallosis (pain, inflammation, deterioration of bone and tissue in the hip area) or have experienced serious adverse health issues related to cobalt and chromium toxicity may be forced to undergo Stryker Rejuvenate/ABGII hip revision surgery. This type of revision surgery is more expensive, and carries more risks for the patient than the original hip implant surgery. The surgery can take several hours, putting patients at risk for excessive bleeding, infection and other complications and the recovery time can be as long as six weeks.
