The DePuy ASR Hip: Status of the Litigation

The DePuy ASR hip implant, approved by the FDA in 2005 and recalled in August, 2010 has had over 6,000 lawsuits filed against DePuy and parent company Johnson & Johnson. For states which operate under a two-year statute of limitations, that SOL ran this past August.

Johnson & Johnson Settles First Three DePuy Cases for over $600,000

Over 8,000 lawsuits have been filed against Johnson & Johnson and its subsidiary, DePuy regarding the ASR metal-on-metal hip implant after it was found to have a much higher than normal failure rate as well as causing other health issues including metal toxicity. In many recipients the metal ball and cup rub against one another with such force that microscopic cobalt and chromium ions are released into the body.

Was Johnson & Johnson Aware of Problems with the ASR Implant?

After the 2010 national recall of defective DePuy ASR hip implants, it was discovered that Johnson & Johnson may have been aware of problems with the product for as long as a year before the recall. The New York Times reported in February 2012 that an internal e-mail at Johnson and Johnson revealed knowledge of the flawed devices as early as 2009, prior to the recall.
