The Stryker Hip Lawyer: Baltimore, Maryland Residents and the Stryker Hip Settlement

Stryker Corporation has recently agreed to a 1.4 billion dollar settlement in its litigation over its Stryker Rejuvenate and Stryker ABGII line of metal hips...Baltimore, Maryland Residents can learn more about the Stryker Hip Settlement here...The Stryker Hip Settlement Explained

The Problems with the Stryker Rejuvenate and ABGII Hip Implants

The July, 2012 Stryker Rejuvenate/ABGII hip recalls dismayed many of those with a Stryker implant. The recall came little more than two years after a major marketing push by Stryker for both models. The Rejuvenate and ABGII were touted as being very different in design from other metal-on-metal hip implants in that a ceramic ball, rather than a metal ball was used. The design of the two implants also included a variety of components which allowed the surgeon to custom-fit the device to the patient, according to the patient’s level of activity, size and gender.

At the time of the Stryker Rejuvenate/ABGII hip recalls, the company stated a higher-than-normal rate of implant failure as well as the propensity for the devices to undergo Stryker Rejuvenate/ABGII hip corrosion and fretting. This fretting and corrosion could then cause excess cobalt and chromium ions to enter the hip tissues and/or the bloodstream. The Stryker Rejuvenate/ABGII hip trunnions, located on either end of the neck piece were also found to trap body fluids, leading to further levels of corrosion.

The Maryland Stryker Rejuvenate/ABGII Hip Statute of Limitations

All states have a statute of limitations for product liability cases. This statute is meant to protect companies from being sued long after all evidence which would prove the case is gone.  Maryland has a slightly longer statute of limitations than many other states; In the state of Maryland, action must be brought within three years of the date the injury occurred. Unfortunately, in the case of injuries caused by a hip implant device, it can be extremely complex to determine exactly when your injury occurred.

As an example, you may have realized you were sick, but did not relate your symptoms to your Stryker hip implant until you heard of the recall. You may not have yet experienced any adverse symptoms associated with your Stryker hip implant, but may wonder how to protect your rights in the event you later develop symptoms associated with your recalled hip device. The best way to determine whether you have a valid Maryland Stryker Rejuvenate/ABGII hip lawsuit is to speak to a Maryland Stryker Rejuvenate/ABGII hip lawyer as soon as possible. In order to get the information you require for your future, speak to a Stryker lawyer today.

Speaking to a Maryland Stryker Rejuvenate/ABGII Hip Lawyer

If you have suffered Stryker Rejuvenate/ABGII hip implant failure and were forced to undergo Stryker Rejuvenate/ABGII hip revision surgery, you must be aware of your rights, as well as your statute of limitations. Over 2,300 lawsuits have currently been filed against Stryker, and more are expected as the state statutes grown near. Approximately seventeen Stryker Rejuvenate/ABGII hip lawsuits have been settled through mediation, and many others are currently undergoing mediation attempts. Bellwether cases—those that are representative of a larger group of Stryker cases are being chosen, and Stryker plaintiffs will be watching those cases to see how juries and judges will react to the presented evidence.
