Talcum Powder Ovarian Cancer: Legal Help

The Dangers of Talcum Powder, Baby Powder with talc, and Shower to Shower (with Talc)

Talcum powder has traditionally been used on babies’ bottoms to help avoid diaper rash and to keep the skin soft and sweet-smelling. Most of us associate the smell of baby powder with warm and fuzzy feelings, however there may be a darker side to talcum powder. Many women—some say as many as 40 percent—use talcum powder as a part of their feminine hygiene routine, sprinkling it into the genital area and on their sanitary napkins. Unfortunately, this practice may be tied to an increase in the risk of being diagnosed with ovarian cancer.

One study which pooled the results of eight research papers and involved nearly 2,000 women, found that women who regularly use talcum powder in the genital region could have a 20-30 percent increased risk of ovarian cancer. Talc is the softest mineral and contains magnesium and silicon. Because talc is often found next to asbestos in their natural state, talc contained some asbestos for many years.

In the 70’s, the United States mandated that there would be no more asbestos allowed in talc products. Unfortunately, talc has minute fibers of its own which may be able to travel through the vagina and fallopian tubes, into the ovaries. Once in the ovaries, inflammation can occur, and, after many years of using talcum powder and the inflammation, ovarian cancer could be the result.

Ovarian Talcum Powder Cancer Lawsuits

There are currently more than 1200 lawsuits filed against Johnson & Johnson by women who used J & J’s baby powder with talc and Shower to Shower with talc. There are other J & J powder products which contain cornstarch rather than talc. The issue is whether Johnson & Johnson should have warned women of the potential risks associated with talcum powder. A recent lawsuit in Missouri resulted in a win for the plaintiff’s family in the amount of a $72 million settlement.

The family of Jaqueline Fox brought a wrongful death lawsuit against Johnson & Johnson for her death from ovarian cancer. Fox had used J & J talcum powder and Shower to Shower for feminine hygiene for more than three decades, and died at the age of 62 after being diagnosed with ovarian cancer. Another lawsuit against J & J in 2013, found that the company exhibited a failure to warn the public about the potential dangers of talcum powder, yet awarded the plaintiff in that case no money. It is likely, after the $72 million verdict, that more women may come forward to file their own lawsuits against J & J for ovarian talcum powder cancer.

Ovarian Talcum Powder Cancer Lawsuit Statutes of Limitations

All states operate under statutes of limitations, which govern the amount of time a person has in which to file a lawsuit for a defective medical device or dangerous drug. Most states allow two years from the time the injury or illness is discovered—or should have been discovered—in which to file the lawsuit. It is important not to miss this window of opportunity, or you could find yourself forever barred from bringing suit against a company which might be responsible for your illness or injury.
